Searches on my Conveyancing Quote

How long do Local Authority search searches take? The wait time for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search electronically some searches are still processed handled manually by the local council. Also the search wait time can be affected by seasonal demand levels and Local Authority staffing levels.

Is there a need environmental investigations in SW12? Statutory laws have resulted in a clean-up scheme for polluted land parcels. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an leasehold in SW12 you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

What is a drainage search ? A water authority search confirms to a new buyer that the land they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of SW12 which are countryside as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your home to take about 2 to 3 months.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a customer makes is not checking the plan properly. It is a best to go to the property to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often clients mistakenly think that a piece of land at the side or rear of the property is theirs, only to discover that the legal title to the land doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all expenses required to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including SW12 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in SW12

Are you on the panel of Virgin Money? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Help to Buy ISAs in SW12? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Inland Revenue is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained Letters of Administration for my parents estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
