Searches on my Conveyancing Quote

How long do Official Local Authority search searches take? The timescale for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches through an electronic search provider some searches are still processed processed manually by the local council. Also the search time can be affected by seasonal demand levels and local council staffing levels.

I am told that the official local Searches in SW6 will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of identifying contaminated areas and recording these land parcels on registers – this is a process which will take a an uncertain amount of time to accomplish. Needless to say any property named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

Why is a a CON29DW useful if you want to extent or alter the property in SW6? One of the basic replies shows a plan of of any public sewer within the home you are buying. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the extension cost more.

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading buying down and have a lot of items to clear. You can accelerate the process if it is a first time buy. You may be able to exchange and complete together. However your desire depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all costs required to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including SW6 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by landlords and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company usually it is approximately £200 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 leaseholds.
