Searches on my Conveyancing Quote

What is included in a local authority search covering TW10? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to public highways, proposals for new roads, railway schemes or planning permissions relating to the land. The search can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I am told that the local Enquiries in TW10 will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of identifying contaminated ground and recording these land parcels on registers – this is a process which will take a an uncertain amount of time to finish. Needless to say any property included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Searches are likely to be incomplete.

Apart from showing that the home in TW10 is connected to the mains water supply and mains drainage what other details does a a CON29 DW search include? A drainage search verifies to a prospective buyer that the land parcel they are buying does not need a “build over consent” because the owner has constructed an alteration over a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

No delays and completed very quickly. Would absolutely use again and would recommend to others. I came across this firm while researching conveyancing issues online, and they had a very informative blog. I have completed the purchase within 3 months without any issues. Mouzzam and Tricia at KER were great. Always quick to reply to my emails and processed paperwork very quickly in relation to my house purchase. Their service was very professional and I would use again. Fantastic service, professional and competent.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is commonly a mortgage loan to obtain and it should be noted that a conveyancer cannot rely on a informal confirmation by mortgage broker or anyone else. The Firm should have sight of your official written offer of mortgage in order that he may (i) ensure that you are getting the loan you need and be sure that you can comply with any lender’s conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays incurred to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including TW10 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

FAQs in TW10

Are you able to oversee a mortgage with Marsden Building Society in TW10? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in TW10.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain steps to facilitate release of those ISAs including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is around £250 but is can be more in unusual cases. Second, the lease often contains a clause for the assigning to pay a charge to the management company based on a percentage of the market value which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
