Searches on my Conveyancing Quote

What is included in a local authority search covering TW9? There are two parts to a local authority search – Local Land Charge Register search and CON29. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

When we obtain a Environmental search on the property mentioned on the conveyancing quote for the property in TW9 what will it reveal? The search provides data of present and past contamination risks together with a assessment from an environmental consultant confirming whether or not the land parcel would be designated contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

What is a Drainage & Water Enquiry ? A a CON29 DW search confirms to a new buyer that the property they are acquiring is connected to the mains water supply and mains drainage. This is particularly important in parts of TW9 which are country as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to get rid of. You can accelerate the process if it is a first time buy. You may be able to exchange and complete together. However your desire depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills needed to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including TW9 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

Are you able to handle a mortgage with Santander in TW9? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in TW9? Is this a problem? No because like all modern firms we count on technology to assist us in our firm to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes TW9.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I am the executor of my family estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.
