What is included in a local authority search covering UB1? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do you recommend that we obtain an Environmental search on the property that we are buying in UB1? Yes we including this in our quote. We would always recommend an environmental search on the properties you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental check results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the site, based upon the information revealed by the search, might be officially names as contaminated land by the Local Authority.

What is a Drainage & Water Enquiry ? A a CON29 DW search confirms to a new purchaser that the site they are interested in is connected to the mains water supply and mains drainage. This is particularly significant in parts of UB1 which are not built up as there may be a a private drainage system.

General Conveyancing Tips

There is invariably a mortgage loan to obtain and it should be noted that a conveyancing solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. He must have sight of your formal written offer of mortgage in order that she may (i) ensure that you are getting the amount you need and be sure that you can comply with any offer conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time in UB1 you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

What SDLT if I am buying a buy to let in UB1? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our family estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
