What is included in a local authority search covering WC2H? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Why do we need environmental checks in WC2H? Statutory rules have resulted in a clean-up system for polluted land parcels. How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a customer makes is not checking the plan properly. It is a best to visit the house to check that what is shown on the plan agrees with what you think you’re buying on site. All too often buyers mistakenly think that a piece of land at the side or rear of the land is theirs,only to find out that the legal title to the home doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses needed to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including WC2H some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the expenses up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing replies often in a form called LPE1. The charge for this varies from company to company on average it is around £200-300 but is can be more in unusual cases. Second, the lease could contains a provision for the assigning to pay a fee to the freeholder based on a % of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.
